Step-by-Step Canadian Refugee Claim Process
1. File the Basis of Claim (BOC) Form
The refugee process begins with submitting a Basis of Claim (BOC) form to Immigration, Refugees and Citizenship Canada (IRCC).
At this stage:
- You will be enrolled in the Interim Federal Health Program
- You may access free newcomer settlement services
The BOC is the foundation of your claim. Accuracy and consistency are essential.
2. Attend Medical Examination
The Canadian government covers the cost of the medical exam.
Asylum seekers must not be medically inadmissible to Canada
3. Attend Eligibility Interview
You will attend an interview with the Canada Border Services Agency (CBSA).
During this stage:
- Biometrics (fingerprints and photo) are collected
- Your passport is surrendered
- CBSA issues an unenforceable removal order
The removal order only becomes enforceable if your claim is refused and all appeals are exhausted.
4. Receive Work or Study Permit
After your eligibility interview, you may receive:
- An Open Work Permit
- Or a Study Permit
Processing times vary, but permits are typically issued within weeks or months.
5. Gather Evidence for Your Hearing
